This policy applies unless a signed project agreement or accepted quotation contains more specific terms. If there is a conflict, the project-specific terms apply to the extent permitted by law. Nothing in this policy removes any right or remedy that cannot lawfully be excluded.
The initial 30-minute consultation is free and carries no obligation. A paid project is booked once the proposal or quotation is accepted and any required deposit has been received. Deposits reserve production time and may also cover discovery, planning, and preparation. Any amount retained after cancellation will be limited to work already performed, authorised non-recoverable costs, and a reasonable cancellation charge permitted by applicable law.
You may cancel a project by sending written notice before work begins. Moody.Tech will refund amounts paid after deducting authorised third-party purchases, non-recoverable payment costs where lawful, completed preparation, and any reasonable cancellation charge. The charge will take account of the services booked, the notice given, capacity reserved, and the reasonable ability to accept replacement work.
If you cancel after work has started, you remain responsible for work completed up to the cancellation date, approved milestones, authorised third-party costs, and any reasonable cancellation charge. Any amount paid above those sums will be refunded. Editable files, credentials, and other deliverables relating to paid work will be supplied where reasonably possible once outstanding amounts are settled.
Fees for completed services, approved milestones, revision work already performed, delivered custom design or development work, and work that has been published or put into use are generally not refundable, except where required by law. A change of mind, a change in business direction, or failure to provide content or feedback does not by itself make completed work refundable.
Hosting, domain registration, paid fonts, plugins, stock assets, software subscriptions, payment-gateway charges, and other third-party purchases are charged separately when applicable. Once purchased or activated, these amounts are subject to the third party’s terms and are usually non-refundable. Moody.Tech will not retain a refund received from a third party that belongs to you.
Consultations and project meetings may be rescheduled with reasonable notice and subject to availability. If content, approvals, feedback, access, or payment is delayed, the delivery schedule may move accordingly. For a prolonged delay, Moody.Tech may provide written notice, pause the project, and propose a revised start date. Any restart fee must be reasonable and disclosed before work resumes.
If Moody.Tech cannot continue a project for reasons not caused by the client, you will receive a refund of the unearned portion of fees paid, after accounting for completed work and authorised non-recoverable third-party costs. Moody.Tech will also provide completed paid-for work that can reasonably be handed over.
Please report a concern as soon as reasonably possible and explain how the service differs from the agreed scope. Moody.Tech will review the concern in good faith and may correct or re-perform the affected work, provide an appropriate credit, or issue a refund where appropriate or required by law. This process does not limit your statutory remedies.
Email moody.techwebdesign@gmail.com with your name, invoice or project reference, the service concerned, and the reason for your request. Moody.Tech aims to acknowledge requests within three business days. Approved refunds are normally returned to the original payment method within 10 business days, although banks and payment providers may take additional time to process them.
Where applicable, this policy is subject to the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002. Rights relating to direct-marketing cooling-off periods, electronic transactions, cancellation of advance bookings, and unsatisfactory services take precedence over any inconsistent term in this policy. Clients outside South Africa also retain any mandatory rights under the law that applies to them.
